Racing Incident Report
MAGIC TEMPLE began awkwardly and lost ground at the start. BEAR DOMINANCE was slow to begin. From the outside gate, WINNING KEVIN was steadied and taken back behind runners to a position on the rail but at the rear. Shortly after straightening, WINNING SUNSHINE was steadied and shifted out after being disappointed for running inside GALLANT KNIGHT. The Stewards deferred the declaration of weighed-in as they were of the view an incident occurred in the Straight which cast sufficient doubt on whether FORTUNE SMILES should be declared the 3rd placegetter in the race. They decided there was justification to have the matter resolved at a formal protest/objection hearing. Following the conduct of that hearing, the Stewards on all the available evidence were of the opinion that GALLANT KNIGHT (B Prebble), the 5th placegetter, near the 250 Metres had established rightful running inside FORTUNE SMILES (D Whyte) and commenced to improve on the inside of that horse with FORTUNE SMILES then shifting in passing the 200 Metres, causing crowding to GALLANT KNIGHT. This crowding continued over the final 200 Metres with GALLANT KNIGHT's rightful running being impeded, causing the horse to become unbalanced near the 100 Metres and again after the 50 Metres. The Stewards formed the opinion that GALLANT KNIGHT would have finished ahead of FORTUNE SMILES had the interference which took place not occurred and accordingly sustained the protest/objection. In sustaining the protest/objection, the Stewards placed FORTUNE SMILES immediately behind GALLANT KNIGHT [Rule 101(2)]. Accordingly the amended placings became No. 4, CZAR OF PRUSSIA, 1st; No. 7, WINNING SUNSHINE, 2nd; No. 1, WINNING KEVIN, 3rd; No. 5 GALLANT KNIGHT, 4th; and No. 6 FORTUNE SMILES, 5th. At a subsequent inquiry, D Whyte was severely reprimanded and told he must at all times do his utmost to ensure other runners which have established running are able to maintain their running unimpeded. B Prebble explained he was of the opinion his mount had finished in 6th position and as such he was not entitled to lodge a protest/objection. B Prebble was reminded of his obligations under the rules to lodge a protest/objection in the appropriate circumstances against a placed horse. At the 200 Metres, DANRIVA was carried wider by CZAR OF PRUSSIA which at this time shifted to the outside of PHOENIX FORTUNE to continue going forward. Near the 100 Metres, MR COOL was bumped by WINNING SUNSHINE which at this time improved on the inside of that horse and outside FORTUNE SMILES. Over the concluding stages, BEAR DOMINANCE hung in. Throughout the race, DANRIVA raced wide and without cover. FORTUNE SMILES, CZAR OF PRUSSIA and WINNING SUNSHINE were sent for sampling.
