Racing Incident Report
CONSTELLATION was difficult to load. Before being allowed to race again, CONSTELLATION will have to perform satisfactorily in a stalls test. SUPER WINNER bounded in the air when the gates opened and lost ground. PLEASANT JOURNEY began awkwardly, shifted out abruptly and lost ground. From a wide gate, HENNESSY DAYS was immediately steadied and taken across behind runners. Shortly after the start, CAPABILITY was bumped by PLEASURE PLEASURE which shifted in after making contact with DOLPHIN STAR. With the intention of being ridden with cover, SILLY BOY was allowed to drift back in the field in the early stages. In the early stages, GOOD TO GREAT raced wide and without cover. In the middle stages and particularly making the turns, PLEASURE PLEASURE hung out. At the 500 Metres, ZHI YOU SPIRIT was steadied when racing tight inside CAPABILITY. On straightening, WONDERFUL BOY was steadied away from the heels of STAR PRODIGY. Over the concluding stages, CAPABILITY hung out and after the 50 Metres became unbalanced. Near the winning post, the whip of D Whyte (CAPABILITY) became entangled in the tail of FORTUNE MAPLE. The Stewards deferred the declaration of weighed-in as they were of a view an incident had occurred inside the final 200 Metres which cast doubt on whether FORTUNE MAPLE should be declared the 2nd placegetter in the race. They decided the matter should be resolved formally at a protest/objection hearing (Rule 123). Evidence was taken from A Delpech, rider of FORTUNE MAPLE and O Doleuze, rider of WONDERFUL BOY, 5th placegetter. The evidence disclosed that inside the 200 Metres FORTUNE MAPLE shifted in when not clear of WONDERFUL BOY, causing that horse to lose its rightful running and be checked. The Stewards formed the opinion, bearing in mind the margin between the two horses at the finish, that WONDERFUL BOY would have finished in front of FORTUNE MAPLE had the interference which did take place not occurred. In sustaining the protest/objection, the Stewards placed FORTUNE MAPLE immediately behind WONDERFUL BOY [Rule 101(2)]. Accordingly the amended placings became No. 3, STAR PRODIGY, 1st; No. 1, SILLY BOY, 2nd; No. 2, CAPABILITY, 3rd; No. 6, WONDERFUL BOY, 4th; and No. 9, FORTUNE MAPLE, 5th. At a subsequent inquiry, A Delpech was found guilty of a charge of careless riding [Rule 100(1)] in that after the 200 Metres he permitted his mount to shift in when not clear of WONDERFUL BOY and FLASH MAC, causing both horses to lose their rightful running and be checked. DOLPHIN STAR, which was racing inside FLASH MAC, was checked in consequence. A Delpech was suspended from riding in races for a period to expire on Thursday 27 October 2005 on which day he may resume race riding (2 Hong Kong racedays). The commencement of the suspension was deferred until after the Happy Valley racemeeting on Wednesday 19 October 2005. In addition, A Delpech was fined $50,000 in lieu of a suspension for a period incorporating two further racedays. O Doleuze was reminded of his responsibility to lodge a protest/objection where the suitable circumstances exist. CAPABILITY, STAR PRODIGY and SILLY BOY were sent for sampling. After the race, the Veterinary Officer reported PLEASURE PLEASURE had lost its right front plate.
